Can You Imagine The Howls From The Left

...if the judge grants Scooter Libby's request for dismissal? The Merry Fitzmas would be officially over.

Filing such things is pro forma, of course, and I'll be surprised if it's granted, but Fitzgerald's stonewalling on the evidence doesn't make his case look very good. It also seems to be on novel grounds.

I don't want to imagine... I want it to be reality. Oh, how much fun it will be.

But alas, that novel approach is sure to cause the left to scream like banshees. The Bushies henchman gets off because other Bushie henchmen operated beyond Constitutional bounds. If the judge rules in favor of Libby, buy duct tape for your liberal friends... their heads will explode.

I don't think Mr. Libby is right on the law. I did a little research and discovered that the AG can delegate any function of his office. Specifically, in Title 28 USC 510:

"The Attorney General may from time to time make such provisions as he considers appropriate authorizing the performance by any other officer, employee, or agency of the Department of Justice of any function of the Attorney General."

As Mr. Comey was the acting AG at the time of the appointment, I think the "Fitzgerald appointment was unconstitutional" argument is not persuasive. I'm confident the court will reject it.

Not being a conservative, I couldn't say, but I wasn't aware that they do. There's no evidence that she was "outed" or a "CIA operative" at the time. Her own lying husband "outed" her himself.

It happened about the same time that Wilson was selling his report (paid for by taxpayers yet not submitted directly to the CIA that sanctioned it with US taxpayers money) to the New York Times.

I'm not saying I know that he did out his wife at that time, but then again, Fitzgerald is not providing evidence that Plame was undercover at that time. So hey, two can play that game.

Let's find out if ujedujik is actually outraged at outing of active covert operations. All he has to do is describe his reaction to the outing of the off-shore "wire-tapping" and air-iraq (about two years ago).

I'll be shocked to find that he's only looking for a club to bash Bush.
