  3. I have only one question I would like asked of Dean Kagan during confirmation hearings:

    “So what is with that haircut, already? It makes you look like Angie Merkel — on a bad hair day.”

  4. My objection to Kagan is that she would be the third New Yorker to be on the court, and that it means the entire court would have graduated from only two schools, Harvard and Yale.

    It seems to me some effort should be made for the court to be representative of the entire United States, not just the narrow 200 mile belt from Boston to New York.

    True, and it formed his value system, but the bulk of his higher education was in New England.

  7. I suspect one could right a pretty good thesis now on
    “Fallacious Reasoning of the Rehnquist/Roberts court”
    a pretty solid critique could be made of many of the
    rulings of Rehnquist and Roberts and why they won’t stand
    the test of time.
