    First, only a small part of management will lose its job. Someone has to run the business. It will continue to run by the people who were already running it. Second, if this went through bankruptcy court, there is the possibility that the owners wouldn’t lose ownership. This expedited process happens to be unfair to a particular group of people, whose assets are seized in the process. Third, I simply don’t buy that the bankruptcy proceedings are too slow to be useful. This is also an usurpation of the judicial branch’s power. Finally, fast bankruptcies, controlled by the executive government, using unaccountable methods like secret bids, are ripe for abuse.
