        I take it you didn’t discuss this article with your lawyers…

        Occasionally referring to someone in a negative way while discussing a public issue like climate change may be defended as free speech. But continued focused attacks on an individual’s professional reputation, especially after they have filed a lawsuit against you for such behavior, moves it more and more across the fuzzy line between expressing free speech and willfully conducting a libel and defamation campaign that may impact that individual’s standing in their field.

        And please, for your sake, don’t answer and give his lawyers more evidence. Just talk to your lawyer. I enjoy your blogging even though we disagree and would hate to see a court ordering you to stop blogging or take your website if you lose this lawsuit.

        As I tell my students in my business law class, going to court, especially in the U.S., is always a gamble where truth and justice are often the first causalities regardless of what legal theory says. So Rand, don’t give them his lawyers the rope they need to hang you with.

          You don’t seem to understand that I welcome this legal proceeding. You also don’t understand that there is no court in the land that could order me to stop blogging, or take my website down, regardless of the outcome.

          1. Using the lecturer’s logic, I think Matula is trying to intimidate Rand by suggesting he’ll be lynched. One wonders if Matula talked to lawyers before making such baldface threats to Rand’s life.

            Blogging is too new an activity to make such assumptions and courts have a lot more leeway than you may think. I do wish you well in your lawsuit but remember, anything may happen and often does when a case goes before a jury.

            I am just pointing out the realities and power of the American legal system. Really, if the Tea Party actually wanted to do something constructive they should work on reeling it in, and I don’t mean by simply replacing one group of activist judges with another.

            Like I said, I find Rand’s views entertaining and so I hope this case turns out well for him.

            Blogging is as protected by the First Amendment as any other type of publication. Every instance in which a judge has tried to shut down a blogger they’ve been slapped down on appeal.

It’s easy for me to say, since I’m not in the line of fire. But, I think Boone and Otter (and Rich Lowry) would advise: To-ga!

          2. Most touch-screen phone browsers use a press-and-hold method to bring up a context menu when “clicking” on a “clickable” object in the browser. YMMV, as usual.
