My guess is that his lawyers regarded the suit against Tim Ball as financially unimportant compared to his lawsuits in DC, and felt that discovery for the Ball case would undermine the others.
Shouldn’t be a problem, hardly an inconvenience if the data he gives in one case matches the data in the other case.
I foresee a long diatribe in the not so distant future about how the forces of light are losing out to the forces of ignorance because one blowhard lost a few lawsuits. Rome will be burning (well, in addition to Earth). Civilization will have fallen. It’ll be sad.
