      Agreed wholeheartedly, I just wish more conservatives got that this applies even when a fellow conservative politician or thought leader suggests trashing due process to “protect us from the terrorists”.

    I really liked Eugene’s paragraph immediately after the Obama quote:
    If you think you can prove someone is a terrorist, lock him up. If you have probable cause to think he’s a terrorist, and think you can develop proof beyond a reasonable doubt, arrest him. Even if you have only suspicion, follow him, ask people about him, and so on. But if you don’t have enough to prosecute or even arrest someone, you can’t take away his constitutional rights, even if you suspect he’s a terrorist (or if you suspect he’s a drug dealer or a gang member or whatever else).

  2. Speaking of constitutional law, it’d be interesting to contrast Obama’s no-fly-list based gun control proposal with Trump’s just-announced plan to bar all Muslim immigration and entry to the USA.

    Personally, provided Trump does not mean to include US citizens (such as a Muslim US citizen on vacation overseas) in that, I think it’s (unlike Obama’s plan) constitutional. There is, after all, no such thing as a right to enter the USA unless you’re a citizen, so the government can refuse entry to anyone else.

    I’d love to hear an explanation from the left as to why Obama’s proposal to use the no-fly-list for gun purchase exclusion of US citizens (a list that’s compiled in secret with secret criteria and no judicial oversight) is constitutional, while Trump’s proposal to bar entry to Muslim non-citizens isn’t?

    This should be very amusing.

  3. And of course, now that we have seen the Obama administration weaponize the IRS, it’s pretty obvious that the no-fly list can be used to hassle his political rivals. After all even Ted Kennedy said the criteria for putting people on the no-fly list is lax.
