  1. I imagine the plaintiff will comb through this blogsite to attempt to prove malicious intent on your part. That will be very interesting.

    His biggest problem, no doubt, will be getting people to believe that he’s not a “public figure.” He’s portrayed himself (falsely, according to the Nobel Committee) as a Nobel Prize winner. Seems like even he thinks he’s more of a public figure than he may actually be. But the “creator of the hockey stick” is going to have a hard time living that title down.

  2. In most parts of the world being humble is seen as an attribute by the courts, from what I’ve seen of this case both sides seem hell bent on out doing the other in obnoxiousness.

  3. Why do I think his #1 hurdle is Mark Steyn? I mean, Mark won his case in CANADA, with CANADIAN laws and CANADIAN courts. I expect little Mikey is going to be Mark’s new chew toy.

    * not to take anything away from the owner of this fine site, but I am less familiar with Mr Simburg’s court room history than Mr. Steyn’s.

  4. When will insurance companies realize that by fighting a few of these spurious suits hard, in court and discovery, bringing the full weight of the litigants’ abuse to light & asking for legal fees and costs and punitive damages with countersuits, they would make this tactic disappear.

  5. It would have been nice if the linked article provided a full quote or a link to the original blog post. It is almost as if they don’t want their readers to be fully informed.

    They do provide a small partial quote on legality from a sciience journalist who’s background is in fossilized coral.
