  1. Today is April 19th, the anniversary of the battles of Lexington and Concord, which set off the American Revolution. So let’s not mar it, people, by celebrating insurrection and sedition!

    In a motion filed Friday to dismiss Bannon’s indictment for contempt of Congress, attorney Bob Costello argued that Pelosi’s rejection of Republican members put forward by House Minority Leader Kevin McCarthy renders the Committee void.

    Neither of Pelosi’s hand-picked GOP patsies, Liz Cheney and Adam Kinzinger, count as the “ranking member” needed by the Committee to issue subpoenas.

      That sounds ridiculous to me. I doubt the Constitution even mentions parties, much less ranking members of parties or throwing together a congressional committee. I imagine the argument is actually that the committee violates Senate rules for constituting a committee and hence, isn’t a proper committee with power to compel testimony or charge people with contempt of Congress. After all, you can’t just throw a bunch of congresspeople together in a room and activate these powers. If you lie to three congresspeople at a bar does that mean you’ve committed perjury to Congress?

    If not unconstitutional, then why can’t you?

    1. When they arrogate to themselves the power to compel people, no, harass common citizens it becomes a problem. There is a separate Judicial branch for a reason.

Bannon’s Lawyer would probably argue that since the committee was convened in a manner inconsistent with the Senate’s own rules for such that it is an “invalid” committee. “Unconstitutional” in the sense that the law presumable requires the Senate to follow its own rules. Their being held in contempt of Congress, they (Congress) are trying to have them tried in court for such. Presumably that opens the door to their arguing to the court that since the Senate didn’t follow its own rules as far as convening the Jan6th committee that their attempt to have them prosecuted in court is therefore invalid. That they can still hold them in contempt of Congress if they wish, but as far as the independent judicial branch is concerned since they didn’t act in accordance with the Senate’s own rules, the court could decide to not act on prosecuting them.

        I wonder if the January 6 hysteria would still be going on, if somehow Trump wasn’t a factor (like dying of old age or somehow announcing in a believable way that he’s never ever going to run for president again). Seems to me that this is all an attack on Trump and the motivation for everything depends on Trump sticking around for the 2024 election.
